REGULAR MEETING
August 8, 1949
The regular meeting of City Council was held on Monday, August 8, 1949 at 7:30 p.m. with Mayor Storey presiding. Members present were Messrs. Behen, Carroll, Culver, Lofland, Petty, Smith and Wilson.
BUSINESS IN RESIDENTIAL SECTION
Mr. Harry Heite protested to Council against the continuance of the business of Paul Cook on South Bradford Street. Council instructed the City Manager to employ Counsel to abate this nuisance.
Mr. Heite’s request to have trimmed a large tree on South State Street was referred to the City Manager.
MINUTES
Minutes of the last regular and special meetings were accepted as read.
BUSINESS IN RESIDENTIAL SECTION
Mr. Harrington requested permission to continue operation of his produce stand at State and Fulton Streets. Council denied permission but allowed him this week to sell out the balance of his stock.
Mr. J. Crowley requested permission to open a produce stand at Governors Avenue and Clara Street. Council denied his request.
STREAM CONTAMINATION
Dr. Stanley Worden reported that overflow from City Sewers at Division and Loockerman Streets was contaminating the stream at the East end of Loockerman Street and creating a health hazard. Council directed the City Manager to investigate the cost of constructing additional sewer lines to alleviate the situation and to check on the possibility of altering or removing the dam behind Legislative Hall.
CITY MANAGER’S REPORT
Report of the City Manager was accepted as read.
CHIEF OF POLICE’ REPORT
Report of the Chief of Police for July 1949 was accepted as read.
REPORTS OF ALDERMAN AND DEPUTY ALDERMAN
Reports of the Alderman and Deputy Alderman for the month of July, 1949 were accepted as read. A check from the Alderman in the amount of $733.60, and from the Deputy Alderman in the amount of $248.15, was remitted to the City.
ORDINANCE
By unanimous vote, Council approved the following ordinance:
AN ORDINANCE TO AMEND AN ORDINANCE REGULATING THE PARKING OF AUTOMOBILES AND OTHER VEHICLES ON THE STREETS OF THE CITY OF DOVER.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:
Section 1. Section 7, Chapter IX of the Ordinances of the City of Dover is amended to add:
It shall be unlawful for any person or persons to park, place or keep any motor vehicle, carriage, wagon or other conveyance along the East curb line of King Street, in front of the Dover Police Headquarters, excepting the Dover Police and their duly and regularly constituted employees.
It shall be unlawful for any person or persons to park, place or keep any motor vehicle, carriage, wagon or other conveyance along the East curb line of Governors Avenue, South of its intersection with Loockerman Street, in an area between 123 feet and 143 feet South of said intersection, excepting the Dover Police and their duly and regularly constituted employees.
It shall be unlawful for any person or persons, while operating a motor vehicle or other conveyance, to make or attempt to make any reverse (“U”) turns at any point on Loockerman Street between State Street and the Delaware Railroad Station, excepting at such point where a traffic circle is provided for making such turn.
It shall be unlawful for any person or persons to park, place or keep any motor vehicle, carriage, wagon or other conveyance in that triangular area, South of the Hotel Richardson in the City of Dover, formed by the intersection of State Street and King Street in said City.
It shall be unlawful for vehicular traffic to proceed on Minor Street between Governors Avenue and Bradford Street in any direction but Easterly. Vehicles shall not park on said Minor Street except to load and unload. Loading and unloading shall be permitted only on the South side of Minor Street.
Section 2. Conviction for violation of any of the provisions of this ordinance shall be subject to the same penalty as provided in Section 7, Chapter IX of the Ordinances of the City of Dover.

W. EDWARD HAMAN PERMIT
Council granted permission to W. Edward Haman to travel from East to West on Minor Street in order to garage his vehicle on that street. City Manager Brown was directed to write the Chief of Police to that effect and to furnish Mr. Haman with a copy of the letter.
NO PARKING SPACE
Council directed that a no parking space be granted WDOV near the entrance to the Ehrlich Building and that the parking meter located there be relocated on Bradford Street in the space now occupied by WDOV as a no parking area, which grant is rescinded.
ORDINANCE - FUEL OIL STORAGE
The City Solicitor was directed to redraft an ordinance submitted to Council to regulate fuel oil storage.
RESOLUTION
By unanimous vote, Council adopted the following resolution.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:
That, that triangular area, South of the Hotel Richardson in the City of Dover, Delaware, formed by the intersection of State Street and King Street in said City, is hereby dedicated to the use of the Delaware Veterans of World War II, Dover Post, for memorial purposes.
WAR MEMORIAL
Council directed that the memorial plot at King and State Streets be laid out to permit vehicular traffic between the memorial and the present curb line south of the Hotel Richardson.
WORKING PRISONERS
A letter from the City Solicitor expressed his opinion that no authority existed for working prisoners on the streets of Dover. The matter was deferred for further investigation.
CELLS
Council approved the construction of two cells in the basement of the present Police Headquarters on King Street. Mr. Behen objected.
YMCA
Council approved removal of the YMCA office from the American Legion building to Police Headquarters, and directed that after the move the American Legion be billed for electric energy consumed.
POLICE RADIO
Council approved the purchase of new Link radio equipment for the City Police at a cost of $1475.00, installed.
OPTION ON LOT EAST OF CITY HALL
Council granted James E. Turner a six months option on a lot East of City Hall comprising 200 feet frontage of high ground and 150 feet frontage of low ground. The option cost is $1.00 and the agreed purchase price $3000. Mr. Turner proposes to construct a bus terminal, subject to Council’s approval of the plans.
RIGHT OF WAY
Council approved a preliminary agreement by which the Pennsylvania Railroad proposes to convey to the City of Dover a right of way West of the railroad near North Street.
RAILROAD CROSSING GATES
Council directed that the Pennsylvania Railroad be notified to remove crossing gates and install watchmen at the Forest and Division Street crossings on or before September 1.
SMOKESTACK - DOVER LAUNDRY
Council directed the City Manager to notify the Dover Laundry to repair its smoke stack.
SALE OF CITY PROPERTY
Council approved disposal by public sale of a City-owned lot at Pennsylvania Avenue and Division Street and a house and lot comprising part of the old Mill property on King Street. The sale was placed in the hands of the Real Estate committee.
CONDEMNATION OF BUILDING
Council condemned as a fire and health hazard a shack owned by Harry Yingling on Cherry Street. Council directed that Mr. Yingling make the building fireproof and safe within 90 days or tear it down.
ORDINANCE
Council directed that the City Solicitor prepare ordinances prohibiting parking in alleys, and giving City Police authority to tow away at the owner’s expense, cars illegally parked.
