REGULAR MEETING

                                                                                                                        December 13, 1948

The regular meeting of City Council was held on Monday, December 13, 1948 at 7:30 P.M. with Mayor Willis Presiding. Members present were Mrs. Frear and Messrs. Carroll, Carson, Culver, Frear, Hartnett, Mikell, Wilson and Wright.

Minutes

Minutes of the last regular and special meeting were accepted as read.

City Manager’s Report

The City Manager’s Report was accepted as read.

Chief of Police Report

Report of the Chief of Police for November 1948 was accepted as read.

Alderman’s Report

Report of City Alderman Conrad was accepted as read. A check in the amount of $606.65 covering collections for November 1948 was remitted to the City.

Election of Chiefs, Robbins Hose Company

Nominations as follows were received from the Robbins Hose Company:

Chief Engineer           Ralph H. Boyer

1st Assistant                Samuel F. Heite

2nd Assistant               Evertson H. Gafford

The Hose Company reported that no election had been required as the nominations had received the unanimous support of all members.

Council confirmed the appointment of the above nominees to the office of Chief Engineer, 1st Assistant and 2nd Assistant.

Victor B. Arrington – Grocery

Victor B. Arrington requested permission to open a grocery store at his residence, 123 N. New Street. The request had been duly advertised in local newspapers. Letters of protest were received from owners of 14 properties in the vicinity. Following consideration of the petition and protests, Council denied Victor B. Arrington permission to open a grocery store at 123 N. New Street.

Street Lighting Contract – Little Creek

City Council approved an agreement for furnishing the Town of Little Creek electric current for street lighting at the rate of six cents (6¢) per KWH when supplied from dark to daylight, and approved all other conditions of the written agreement.

City Council directed the City Manager to determine the amount the Town of Little Creek had overpaid for electric current during the term of its previous agreement (11 years) and to complete some equitable method of adjustment with the Town Commissioners of Little Creek.

Electric Rates – Seasonable Customers

Council directed the City Manager to survey present rates to seasonable users of electric current and report his recommendations for changes at a future meeting of Council.

Paving Street – North New Street

A request was received from citizens of Dover requesting that the 400 block of North new Street be improved. Council appointed Mr. Carson and City Manager Brown to inspect the street and decide upon what improvement could immediately be made.

Dover Recreation Council Donation

Council approved a contribution of $4500 to the Dover Recreation Council for the calendar year 1949. Payment is to be made at the rate of $500 per month until the total is paid.

Pension Plan

Council directed that the City Manager present to City Council for its consideration various pension plans for city employees studied in the past.

Public Utility Rates

City Solicitor Magee reported that, in his opinion, the Charter of the City of Dover contained no authority permitting the City to require public carriers or public utilities to publish rate schedules. Council directed that the Dover Chamber of Commerce be notified of this opinion in reply to their request for such an ordinance.

Ordinance – Trailers

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:

No person, firm, association or corporation being the owner of, tenant of, or in possession of any trailer, portable structure or any vehicle so constructed and designed as to permit occupancy thereof for dwelling, business or sleeping purposes shall park or deposit the same on any property, the extremities of which abut on the streets, lanes or alleys of the City of Dover without first obtaining a permit from the City Council.

Any person, firm, association or corporation convicted of the violation of this ordinance shall be guilty of a nuisance and upon conviction thereof be fined not less than Five Dollars ($5.00) nor more than Twenty-five dollars ($25.00) for each day that such nuisance continues. It shall be the duty of the owner or tenant of such trailer, portable structure or any vehicle so constructed and designed as to permit occupancy thereof for dwelling, business or sleeping purposes, to remove the same within twenty four hours after notice so to do by the City Manager, and failure by any person, firm, association or corporation to remove the same shall shall be punishable by a fine of not less than Five Dollars ($5.00) nor more than Twenty-Five Dollars ($25.00) for each day such failure or refusal continues. The City Manager shall have authority to remove such nuisance and to charge the costs thereof to the party or parties responsible.
