REGULAR MEETING
November 13, 1945
The regular meeting of City Council was held on Tuesday, November 13, at 7:30 P.M. The meeting was called to order by Mayor J. Wallace Woodford and the following members were present: Messrs. Keith, Burton, Hartnett, Vane, Hinkle, and Carson.
MINUTES
Upon motion of Mr. Burton seconded by Mr. Keith, it was voted to dispense with the reading of the last regular and special meetings.
CITY MANAGER’S REPORT
The City Manager’s report for the month of October was read and upon motion of Mr. Keith, seconded by Mr. Carson, the report was accepted.
TRAILER ORDINANCE
The City Manager reported that during the past few months a number of trailers have located within the city limits and that others had requested permission to do likewise. The City Manager has in no case granted permission for them to locate, although there is no City Ordinance covering it. He suggested that an ordinance be adopted to cover trailers and trailer camps within the city limits. After some discussion, the City Solicitor was instructed to find out what other cities were doing with respect to trailers and trailer camps and to report at a subsequent meeting of Council.
ALDERMAN’S REPORT
The Alderman’s report for the month of October was presented together with a check in the amount of $424.50. This report showed 33 arrests. Upon motion of Mr. Barton, seconded by Mr. Hinkle, the report was accepted.
WALTER E. HOLT – FINE
Upon motion of Mr. Carson, seconded by Mr. Keith, the fine of Walter E. Holt for violation of section 25, M.V.L. was ordered remitted.
CHIEF OF POLICE REPORT
The report of he Chief of Police was presented. Upon motion of Mr. Hinkle, seconded by Mr. Burton, the report was accepted.
PLANNING COMMISSION
As instructed by Council at their last regulatory meeting, Mayor Woodford appointed the following to comprise the Planning and Zoning Committee: John P. LeFevre, Gilbert Wilcox, Harry K. Heite, Edward Haman, William C. Boyer, Jr.
ORDINANCE
An ordinance entitled, AN ORDINANCE REGULATING THE COLLECTIONOF GARBAGE AND RUBBISH WITHIN THE CITY LIMITS OF THE CITY OF DOVER, AND PRESCRIBING RULES AND REGULATION WITH REFERENCE THERETO, was passed upon the following vote: Keith-yes, Burton-yes, Hartnett-yes, Vane-yes, Hinkle-yes, Carson-yes.
AN ORDINANCE REGULATING THE COLLECTION OF GARBAGE AND RUBBISH WITHIN THE CITY LIMITS OF THE CITY OF DOVER, AND PRESCRIBING RULES AND REGULATIONS WITH REFERENCE THERETO.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:
SECTION 1. That from and after the passage and approval of this ordinance, the following rules and regulations shall be applicable to the collection of garbage and rubbish by the City of Dover, and said rules and regulations are hereby established and compliance therewith is hereby required by all persons, firms, associations and corporations using the facilities of the City of Dover for the collection of said garbage and rubbish.
A. DEFINITION
Garbage and combustible refuse shall mean all solid and semi-solid kitchen refuse subject to decay or putrefaction and all market waste of animal and vegetable matter which was intended to be used as food. It shall also include animal offal, carcasses of dead animals, waste animal matter from butcher store and all combustible substances from public and private establishments and residences. For the purposes of this ordinance, sawdust, scrap lumber, paper, cardboard and cardboard cartons and other combustible refuse shall be considered as garbage.
Rubbish shall include all wastes not subject to decay or putrefaction from all public and private establishments and residences. It shall include ashes, brush, tree and garden clippings, dirt sweepings, tin cans, glass articles and all other incombustible substances. Due to the large amount of water content, substances like watermelon, cantaloupe, tomato skins, corn husks, peach peelings, bean hulls, etc. cannot be burned at the incinerator and must be disposed of at the City dump as rubbish
All garbage and combustible refuse shall be separated from rubbish before it will be collected.
On collection days all garbage and rubbish shall be placed in separate piles or receptacles on the sidewalk or alley from which the collection thereof is to be made.
B. COLLECTION OF GARBAGE AND COMBUSTIBLE REFUSE
Garbage must be drained and wrapped in paper of sufficient thickness to insure carrying. No garbage sufficiently liquid that it cannot be wrapped in paper will be removed by the collectors. Garbage containers shall not be larger than 18” x 26”, or , when full, shall not weigh over 100 lbs., and must have tight-fitting lids.
Sawdust must be placed in boxes with tight lids and tied with cord. No loose garbage or other combustible refuse will be accepted by collectors and must be removed by owners or residents immediately. Containers must not be so full that the contents will spill when being handled by collectors.
C. COLLECTION OF RUBBISH AND INCOMBUSTIBLE REFUSE
Rubbish as defined above must not be mixed with garbage. It shall, whenever possible, be placed in boxes or baskets, but each container shall not weigh over 75 lbs. gross or exceed 24” square. Ashes must be placed in tight containers and must not weigh over 100 lbs. gross.
D. COLLECTION DAYS FOR GARBAGE ONLY
Monday and Thursday: Division Street an all streets and alleys north of Division Street.
Tuesday and Friday: Loockerman street and all sections between Loockerman Street and Division Street, including west of the railroad on Forrest Street to Saulsbury Road.
Wednesday and Friday: All sections south of Loockerman Street.
E. COLLECTION DAYS FOR RUBBISH ONLY
Rubbish will be collected on Tuesday and Friday.
No garbage or rubbish collection will be made on New Year’s Day, Decoration Day, July 4th, Labor Day, Thanksgiving or Christmas Day, but will be made on the next weekday following such holidays.
F. GENERAL RULES
All garbage and rubbish from Loockerman Street and Minor Street must be put out for collection on the morning of collection day prior to 8:30 A.M. Any garbage and rubbish put out in these locations after this hour will not be collected by City trucks.
In all other alleys, garbage and rubbish may be put out on the night before collection day, but for locations where there are no alleys garbage must be put out on the sidewalk prior to 8:30 A.M. on collection day. Loose paper shall be placed in tight containers to keep it from being scattered. Empty containers must be removed on the same day.
Garbage will not be received at the incinerator on Saturday. The City dump will be open on Saturday only until noon. Special arrangements must be made with the attendant if it is desired to use the dump on Saturday afternoon.
Private trucks hauling to the dump shall comply with the regulations regarding dumping and shall cooperate with the attendant in charge of the dump.
The City will make no charge for collecting brush, tree and garden clippings, vines or other bulky or unusual substances aggregating at any collection day not more than one cubic yard or one-half truck load. Construction refuse will be collected at a special cost of $3.75 per hour including truck, truck driver and two laborers. Tree limbs or other bulky substances aggregating more than one-half cubic yard or one-half truck load will be collected at a charge of $2.00 per truck load or $1.00 per half truck load.
SECTION 2. Any person, firm, association or corporation violating any of the provisions of Section 1 here of, or any part thereof, shall upon conviction thereof be fined not less than Five ($5.00) Dollars nor more than Fifty ($50.00) Dollars for each separate offense, and upon failure to pay the fine imposed herein shall be imprisoned not exceeding twenty (20) days.

ROBBINS HOSE COMPANY
A letter was read from Ralph Boyer stating that at the regular meeting of Robbins Hose Company on October 29th, the following were nominated:
Fire Chief Thomas E. Baker
1st Asst. Chief H.A. Golt
2nd Asst. Chief Robert C. Densten
Since no election is necessary where there is but one nominee, it was the desire of the company that the above names be accepted by Council. Upon motion of Mr. Keith, seconded by Mr. Carson, the above nominees were accepted and the Clerk was directed to acknowledge confirmation.
ACCOUNTING PROCEDURE
Some months ago the present accounting system was discussed with the idea of putting in a system which would give more information and data and flexible enough to conform to the Public Utilities Commission method of accounting should such a commission ever be appointed in Delaware. A system has now been prepared by Mack and Company of Wilmington, and has been approved by the Chief Accountant of the Maryland Public Service Commission. Upon motion of Mr. Burton seconded by Mr. Hinkle the City Manager was authorized to put into effect the new method of accounting.
DOVER PUBLIC SCHOOLS
The City Manager reported that the electric account of the Dover Public Schools was in arrears in the amount of approximately $1300.00 dating as far back as 1939. After some discussion it was decided to present this bill to the Claims Committee of the next Session of the Legislature for their consideration.
BUSINESS DISTRICT AND FIRE AREA
As requested at the last regular meeting of Council, the City Manager submitted the survey to clarify the conflicting Business and Fire Area Ordinances. After some discussion it was decided to let the Post War Planning Committee after discussing it with the Chamber of Commerce, made the final decision.
