REGULAR MEETING

            The Regular Meeting of the City Council of the City of Dover was held on the 13th day of December, 1943. The Meeting was called to order by Mayor Woodford at 7:30 P. M., and on roll call the following members answered “Present”: Messrs. Keith, Burton, Vane, Hinkle and Hartnett.

MINUTES

            Upon motion of Messrs. Burton and Hinkle, the reading of the minutes of the last regular meeting was dispensed with.

CITY MANAGER’S REPORT

            The City manager’s Report for the month of November was read by the Clerk and accepted upon motion of Messrs. Keith and Burton. upon motion of Messrs. Burton and hinkle, the City manager was authorized to continue with the preparation of plans, specifications, and costs of the new switchboard referred to in his report, and make a report of his findings at a Special Meeting of Council to be held during the coming month.

            Upon motion of Messrs. Burton and Hinkle, the City Manager was instructed to submit his findings of the recreational survey of the City to the existing recreational committee.

ALDERMAN’S REPORT

            The Alderman’s report for the month of November was read by the Clerk and accepted upon motion of Messrs. Hinkle and Burton. A check amounting to $154.80 was turned over to the City Manager with the report of twenty-three (23) arrests.

POLICE REPORT

            The report of the Chief of Police was read by the Clerk and approved upon motion of Messrs. Burton and Hartnett.

COMMITTEE

            Mr. Charles Paradee, who resides on Rodney Road in Dover, appeared before Council asking that Council grant him a permit to build a Double bungalow on Washington Street. Council informed Mr. Paradee that he would have to make a written application, accompanying it with Blueprints and specifications of the building which he would like to construct.

ORDINANCES

            Upon motion of Messrs. Keith and Burton, an Ordinance relating to the Control of Rooming Houses within the City of Dover, was presented to the City Council and passed upon the following vote:

                                    Keith, yes;

                                    Vane, yes;

                                    Hartnett, yes;

                                    Burton, yes;

                                    Hinkle, yes.

AN ORDINANCE RELATING TO THE CONTROL OF ROOMING HOUSES WITHIN THE CITY OF DOVER.

            SECTION 1.   No person being the owner, occupant or person in charge of any dwelling house, hotel or any other building shall lease or rent any rooms either for transient or permanent occupancy within the City of Dover except as hereinafter provided.

            SECTION 2.   Any person being the owner, occupant or in possession or control of any dwelling house, hotel or other building within the City of Dover who is engaged in the business of renting rooms therein to three or more persons, or whose rooms are designed to accommodate three or more persons, shall register such rooms with the City Manager of the City of Dover, and shall state in addition to any other information required by the City Manager the number of bedrooms available for such rental, the number of stories to the house, hotel or building where such rooms are being rented, the number of occupants permitted for each rented bedroom, the number of bedrooms connected with or included in any group of rooms commonly designated as apartments, either with or without cooking facilities, and whenever required, a floor plan of HTE dwelling house, hotel or building where such rooms are to be leased or rented. The provisions of this ordinance shall be applicable to any building where rooms are leased for use as bedrooms.

            SECTION 3.   Upon HTE filing of such statement and the giving of the required information the said person desiring to rent such rooms shall make application for a permit so to do, and such permit shall be issued by the City Manager upon a proper showing that the provisions of this ordinance will be complied with, and for which permit a permit fee or charge of Two ($2.00) Dollars shall be made. Each permit shall expire on December 31st next following the issuance thereof. Renewal permits may be had upon application being made to the City Manager and the payment of a renewal fee of One ($1.00) Dollar.

            SECTION 4.   No permit shall be issued until it be shown to the satisfaction of the City Manager that

            (a)       Every room in any multiple dwelling rented to either transient or permanent occupants shall contain at least 400 cubic feet volume for each adult occupant and at least 200 cubic feet volume for each child under twelve years of age, and

            (b)       For every dwelling in which more than ten persons sleep above the first story, whether they are members of the family or roomers paying rent, there shall be provided two methods of egress from every story above the first story. The second means of egress may be an additional stairway inside or outside the building or it may be a balcony fire escape, and

            ( c )     That the heating equipment used in such rooms shall be approved by the Fire Marshall of the City of Dover.

            SECTION 5.   Any permit issued under the provisions of this ordinance may be revoked at any time when proof of violations of any of the provisions of this ordinance are found. Inspection of such rooming houses shall be made at reasonable hours under the supervision of the City Manager, by the Fire Marshall of the City of Dover or such other person or persons as may be designated by the City Manager.

            SECTION 6.   Any person or persons being the owner, occupant or person in charge of any dwelling house or any suite of rooms located in any dwelling house or apartment who shall violate the provisions of this ordinance shall upon conviction thereof be fined not less than Five ($5.00) Dollars nor more than Twenty-five ($25.00) Dollars for each separate offense, or be imprisoned not in excess of ten (10) days, or by both fine and imprisonment. Upon the conviction of any person or persons for violations of this ordinance or any provisions thereof, any permit then held by such person or persons so convicted shall be immediately revoked and shall not be renewed until satisfactory arrangements have been made with the City Manager that will satisfy the City manager that strict compliance with the terms of this ordinance will be had.

            Upon motion of Messrs. Keith and Hartnett, AN ORDINANCE RELATING TO MOTOR VEHICLES ABANDONED BY THEIR OWNERS ON THE PUBLIC STREETS, LANES OR HIGHWAYS OF THE CITY OF DOVER was presented to the City Council and passed upon the following vote:

                                                Keith, yes;

                                                Vane, yes;

                                                Hartnett, yse;

                                                Burton, yes;

                                                Hinkle, yes.

AN ORDINANCE RELATING TO MOTOR VEHICLES ABANDONED BY THEIR OWNERS ON THE PUBLIC STREETS, LANES OR HIGHWAYS OF THE CITY OF DOVER.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:

            SECTION 1.   That from and after the passage and approval of this ordinance it shall be unlawful for any person being the owner or in charge of any motor vehicle to abandon said motor vehicle upon any of the streets, lanes, or alleys within the corporate limits of the City of Dover.

            SECTION 2.   For the purpose of this ordinance, any motor vehicle which has remained in one location for a period in excess of one week continuously shall be considered to be abandoned by the owner or owners or persons having charge thereof or being responsible therefor.

            SECTION 3.   Any person being the owner or person in charge of or responsible for any motor vehicle which shall be abandoned or which shall be left parked upon any of the streets, lanes or highways within the City of Dover for a period of severn continuous days or more shall, upon demand made to such owner or person in charge or person having responsibility therefor, immediately remove said motor vehicle from the said streets, lanes or highways of the City of Dover, and upon failure to do so within three days after notice so to do from the Police Department of the City of Dover, the said City of Dover, through is proper employees, shall remove said vehicle or vehicles and shall store the same at the expense of the owner or owners or person in charge or having the responsibility therefor, and upon the failure of such person or persons to pay such storage, said The City of Dover shall have the right to sell such vehicle or vehicles and shall apply the proceeds from said sale—first, to the expense of moving and storing such vehicle or vehicles; secondly, to any lien holder having a valid lien on said motor vehicle, if any, who shall prove said lien; and third, any residue shall be paid over to the owner or owners or other person entitled to such balance.

            SECTION 4.   Any person or persons being the owner or person in charge of or responsible for any motor vehicle abandoned upon the public streets, lanes or highways of the City of Dover shall upon conviction thereof be fined not less than Five ($5.00) Dollars nor more than Fifty ($50.00) Dollars, or upon failure to pay the fine, shall be imprisoned not in excess of twenty-five (25) days or by both fine and imprisonment.

APPONITMENT OF TAX ASSESSOR

            Upon motion of Messrs. Keith and Hinkle, Thomas E. Baker was appointed City Tax Assessor for the Year of 1944.
