REGULAR MEETING

                                                                                                                        December 9th, 1940

            The regular meeting of the City Council of the City of Dover was held on the 10th day of December, 1940. The meeting was called to order at 7:30 P. M. with Mayor Woodford presiding and on roll call the following members answered present: Messrs. LeFevre, Downes, Keith, Burton, Frear, Vane and Hinkle.

MINUTES

            Upon motion of Messrs. Burton and Hinkle, the reading of the minutes of the last regular and special meetings was dispensed with.

CITY MANAGER’S REPORT

            The City Manager’s report for the month of November was read by the Clerk and accepted upon motion of Messrs. Keith and Downes.

            Upon motion of Messrs. Keith and Downes, the City manager was instructed to notify Mr. Walter Minner to remove the two back rooms in the rear of Tony’s Shoe Shop, and to send a thirty-day notice to Mrs. Sallie Massey to remove the old building in the rear of her property.

            Upon motion of Messrs. LeFevre and Downes, the matter of acquiring additional ground for dumping refuse from the incinerator was referred to the City Manager, with the power to act.

FINANCIAL REPORT

            The financial report for the month of November was read by the Clerk and approved upon motion of Messrs. Keith and hinkle.

POLICE REPORT

            The report of the Chief of Police was read by the Clerk and approved upon motion of Messrs. Hinkle and Vane.

 

ALDERMAN’S REPORT

            The Alderman’s report for the month of November was read by the Clerk and accepted upon motion of Messrs. Burton and Hinkle. A check amounting to $26.00 was turned over to the City Manager with the report of four arrests.

COMMITTEE

            A committee of colored citizens appeared before Council asking that a stop sign be placed at the corner of Fulton and Queen Streets, on Fulton Street. Upon motion of Messrs. LeFevre and Keith, the City Manager was authorized to put up proper signs for the protection of children playing around that corner.

ASSESSOR

            Upon motion of Messrs. Hinkle and Burton, James B. Keith was appointed City Tax Assessor for 1941.

PENSION

            Upon motion of Messrs. Burton and Keith, Lewis Chambers, who has been employed by the City of Dover for a great may years, was given a pension of $10.00 per week for an indefinite period.

            Upon motion of Messrs. Burton and Downes, Council voted that the building permit of Clements Cleaners would not be issued until the back tax bills were paid in full.

ROBBINS HOSE COMPANY ELECTION

            Upon motion of Messrs. Burton and LeFevre, the returns from the Robbins Hose Company were checked and approved by the City Council.

ORDINANCE

            The following ordinance was passed by vote as follows:

                        Messrs.           Downes, yes;

                                                LeFevre, yes;

                                                Burton, yes;

                                                Keith, yes;

                                                Vane, yes;

                                                Hinkle, yes;

                                    and      Frear, yes.

AN ORDINANCE RELATING TO THE HEALTH QUALIFICATIONS OF EMPLOYEES OF EATING ESTABLISHMENTS IN THE CITY OF DOVER, AND TO THE SANITARY CONDITIONS OF SUCH ESTABLISHMENTS.

BE IT ORDAINED, by the Council of the City of Dover in Council met:

SECTION 1.   No person, firm, association or corporation operating or carrying on any dining room, restaurant, sandwich shop, soft drink establishment, or other place where foods, drinks, confectionary, or condiments are served to the general public within the city limits of the City of Dover shall employ any person or persons to prepare or distribute such articles of food or drink as aforesaid unless such person or persons shall secure a certificate from a competent physician from within the City of Dover, certifying that such person or persons is free from any infectious or contagious disease; and no employer, as aforesaid, shall maintain or keep any person or its employment until such a certificate shall have first been obtained from a competent physician as aforesaid, certifying that such employee is free of any contagious and infectious disease.

            The provisions of this section shall be applicable to all persons who shall handle the food in any of the stages, particularly in the preparation, cooking, and distribution of nay food in any establishment where any food is prepared, or sold, or distributed to the general public in the City of Dover, as aforesaid.

            SECTION 2.   It shall be unlawful for any person to work or to assist in the preparation, cooking, or distribution of any food or foods served or to be served to the general public in or from any eating house or establishment in the City of Dover, who, at the time of the preparation or assistance in the preparation or distribution of such food shall be infected with any contagious or infectious disease.

            SECTION 3.   All persons, firms or corporations supplying eating establishments in the City of Dover, where food is served to the general public shall provide the following:

            A.        An adequate supply of water of the quality approved by the Board of Health of the City of Dover,

            B.        Shall provide water-flushed toilets with a disposal system approved by the Board of Health of the City of Dover, for the use of the employees of said establishments; which toilets shall be kept in a sanitary condition, screened against flies. No toilet shall open directly off the kitchen, nor in close proximity to the kitchen or kitchens of such establishment. Where toilets are used by both the employees and the public, such toilets shall be located as to not require passage of the persons using the same, other than the employees, through the kitchen or kitchens of such establishment or eating place.

            C.        Shall provide washing facilities containing soap disbursers of a satisfactory pattern, and sanitary methods for the drying of hands. The use of a common towel is forbidden. All employees shall be required to wash and dry the hands after using the toilets.

            D.        All garbage shall be stored in fly-tight depositories and the premises shall be kept free at all times of any accumulations of garbage or rubbish.

             E.        Complete and effective screening of the premises against insects shall be maintained.

            F.        All food on the premises, whether stored or exposed, for sale, shall, unless packed in single-service, fly-tight containers, be contained in suitable covers.

            G.        All single service cups, dishes, spoons and drinking straws shall be protected by suitable covers, and all tableware subjected to repeated use shall be thoroughly washed and sterilized in the manner approved by the Board of Health of the City of Dover. Napkins shall not be used a second time until first thoroughly cleansed in the manner approved by the Board of Health of the City of Dover.

            H.        Storage of food directly in contact with ice is hereby prohibited. All ice-boxes and refrigerators must at all times be kept in a clean and sanitary condition.

            I.         Floors of all rooms where reserve supplies of food are stored shall be impermeable and rat-proof.

            SECTION 4.   The Board of Health of the City of Dover is hereby authorized to inspect any public eating house or establishment in the City of Dover, and to determine by such inspection as may be proper and necessary that such eating place or establishment is in compliance with the provisions of this ordinance. It shall be the duty of any employee of such eating place or establishment to exhibit at the time of such inspection, his or her certificate showing freedom from contagious or infectious diseases. Any person failing to exhibit such certificate shall be suspended from his or her duties until such certificates shall be secured and exhibited to the Board of health of the City of Dover, or to its representative duly designated by said Board of Health. It shall be the duty of any employer, supervisor, or manager to suspend such employee upon the request by the said Board of Health of the City of Dover for failure to provide and exhibit such certificate as herein provided for under the provisions of this ordinance.

            SECTION 5.   Any person, firm, association, or corporation who, or which, shall be convicted of violating any of the provisions of this ordinance shall be fined not in excess of fifteen dollars ($15.00) for each separate offense. Each day that such violation shall continue shall be deemed a separate offense.

            Upon failure to pay the fine imposed, such defendant may be imprisoned not exceeding ten days.
