Regular Meeting
November 13th, 1939
The regular meeting of the City Councl of the City of Dover was held on the 13th day of November, 1939. The meeting was called to order by Mayor Woodford and on roll call the following members answered present: Messrs. LeFevre, Downes, Keith, Millman, Frear, Burton, Vane and Hinkle.
MINUTES
Upon motion of Messrs. Vane and Burton, the reading of the minutes of the last regular meeting was dispensed with.
CITY MANAGER’S REPORT
The City Manager’s report for the month of October was read by the Clerk and accepted upon motion of Messrs. Downes and Keith.
Upon motion of Messrs. Keith and Hinkle, the City Manager was authorized to extend the electric lines on the postles Corner Road from Postles Corner north on the 9’ road a distance of one mile.
Upon motion of Messrs. Hinkle and LeFevre, the City Clerk was instructed to draw an order on the treasurer for $5,000 as a payment on the $25,000 note at the Farmers Bank.
Upon motion of Messrs. LeFevre and Hinkle, the City Solicitor was instructed to prepare an ordinance regulating the parking of automobiles overnight on the streets of Dover, this ordinance to be presented at the next regular meeting.
Upon motion of Messrs. Keith and Burton, the City Solicitor was instructed to prepare an ordinance making New Street and Bradford Street “through” streets from Loockerman Street north to the City limits. (The above ordinance was passed in February, butis now to be put into effect).
Upon motion of Messrs. Keith and Burton, the Mayor appointed Messrs. Vane, Downes and Frear as a committee to cooperate with the City Manager in numbering the houses in the City and preparing street signs.
FINANCIAL REPORT
The financial report for the month of October was read by the Clerk and approved upon motion of Messrs. Burton and Millman.
ALDERMAN’S REPORT
The Alderman’s report for the month of October was read by the Clerk and approved upon motion of Messrs. Burton and Hinkle. A check amounting to $14.00 was turned over to theCity Manager with the report of five arrests.
POLICE REPORT
The report of the Chief of Police was read by the Clerk and accepted upon motion of Messrs. Keith and Millman.
COMMITTEE
Mr. Howard E. Lynch, Jr. appeared before the City Council as president of the Dover Special School District Board, explaining that the new school buildings were completed, and in-as-much as their budget was not increased for the running of the school, he asked that the City give the School Board free light, pave certain districts for parking areas, install sidewalks where needed and employ a man annually for the purpose of instructing athletic activities and keeping the field house in condition for use at all times. After some discussion, upon motion of Messrs. LeFevre and Downes, Council voted that the Mayor and City Manager meet as a committee with the over School Board to work out some plan that the Board would like to present to the City Council at their next regular meeting.
Mr. John MacDonald appeared before Council as chairman of a committee from the Junior Chamber of Commerce, asking that the City Council donate a purse to be used for prizes to be offered for decoration of residences in the City during the Christmas holidays; also, that the City Council purchase pamphlets on lighting for distribution and put some form of Christmas advertising on the electric bills for the next month. Upon motion of Messrs. Keith and LeFevre, the City Council appropriated $100 to be used for prizes for the best decorated houses within the City limits for the holidays.
Referring to the letter and claim made by James C. Wickes at the last regular meeting of Council, after some discussion, upon motion of Messrs. Downes and LeFevre, Council instructed the Clerk to draw an order on the treasurer in favor of Mr. Wickes for $150 in full settlement for the claim.
TREES
Upon motion of Messrs. Hinkle and Downes, the City Manager was authorized to mvoe dead trees at the folliwng locations: one in front of Dr. Stout’s property on Reed Street; one on Elm Terrace and one on Fulton Street between Governors Avenue and New Street in front of the Leverage property.
BUILDING PERMIT
Upon motion of Messrs. Keith and Hinkle, Council voted to grant a building permit amounting to $500 to Joshua Griffin for the purpose of moving and making alterations on his house located on the alley between Queen and Kirkwood Streets.
ORDINANCE
The following ordinance was passed upon by the following vote:

AN ORDINANCE REGULATING THE BUSINESS OF TOURIST HOMES OR ACCOMMODATIONS WITHIN THE CITY LIMITS OF THE CITY OF DOVER, AND FIXING FEES AND REGULATIONS THEREFOR.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:
SECTION 1. That from and after the passage and approval of this ordinance, it shall be unlawful for any person, firm, association or corporation to conduct, maintain or carry on, or to offer to conduct, maintain or carry on, or to offer to carry on by any advertisement by any sign, poster or otherwise, the business of a Tourist Home or Tourist accommodation in any residence, apartment house or hotel within the residential sections of the City of Dover, outside of the section of the City of Dover set apart as and for business sections, without obtaining a permit to carry on such business as hereinafter provided.
SECTION 2. That before continuing the business of conducting a Tourist Homeor accepting persons for over night board or lodging in the case of any place where Tourist Homes are now conducted within the City of Dover, outside of the business areas thereof, and before beginning the business of conducting a Tourist Home or supplying Tourist accommodations as a new business in any location within the said city limit of the City of Dover outside of the business districts of said City of Dover, the person or persons, firm or association desiring to conduct such business or to continue such business shall make application to the City Manager of the City of Dover for a permit to carry on said business, and shall pay to the said the City Manager, a pemit fee of Five ($5.00) Dollars, to be paid at the time of filing such application, and which permit fee shall be returned in the event that such application shall not be granted.
SECTION 3. Before any permit shall be granted to any person, firm, association or corporation to carry on the business of conducting a Tourist Home or supplying Tourist accommodations within the city limits of the City of Dover, outside the business areas of said city, the applicant therefor shall file the following information to be incorporated in the application for such permit, namely:
A. The full name and address of the party or parties interested in conducting such Tourist Home.
B. The location of such Tourist home and whether or not the whole of the property will be used for such purpose or only a part thereof.
C. A statement showing the type and location of all advertising material, signs or fixtures used upon the premises to advertise such property as a Tourist Home or as a place supplying Tourist accommodations. The City Manager may require detailed plans and specifications showing the type and location of such advertising material.
D. Applicant agrees not to make any material changes either in the property or in any of the advertising material, signs or fixtures used in or about said business until the same shall have been approved by the City Manager.
SECTION 4. No permit shall be granted where it appears from the statement so filed that such advertising material, signs or fixtures to be used by said applicant will be placed upon the lawns adjacent to the buildings wherein such business is to be conducted or where it appears that such advertising material, signs or fixtures will be used on the outside of such building or buildings, unless the Council of the City of Dover shall first have approved the type and location of the same.
SECTION 5. No permit shall be granted until the advertising material, signs or fixtures to be used shall be of a design and material and quality approved by the City Manager, except as provided in Section 4 hereof.
SECTION 6. No advertising material, signs or fixtures shall be installed or used until the same shall have been fully inspected and approved by the City Manager, nor shall any advertising material, signs or fixtures electrically operated be installed or used unless and until the same shall have been approved by the Underwriters Association, or its duly constituted representative having jurisdiction in the City of Dover at the time of such installation or use.
SECTION 7. No permit shall be granted where it appears from the application that because of the location of the property to be used or the nature of the advertising material, signs or fixtures used in connection therewith, that the appearance and beauty, health, safety, convenience, comfort and well being of the population of the neighborhood wherein such business is to be conducted, would be adversely effected, or that the property located in said district would be materially reduced in value because of the business to be conducted by said applicant in the place or places designated.
SECTION 8. Any applicant shall have the right of appeal to the Council from any of the findings of the City Manager, where the City Manager has original authority t issue permits under the provisions of this Ordinance.
SECTION 9. Any person, firm, association or corporation violating any of the provisions of the Ordinance, upon conviction thereof, shall be fined not less than Five ($5.00) Dollars or more than Twenty-five ($25.00) Dollars for each day that such business is carred on contrary to the provisions of this Ordinance.

A PERMIT
An application for a permit for operating a tourist home on North State Street for the year 1940 was made by Mr. G. N. Acker. Upon motion of Messrs. Downes and Vane, the application was received and Mr. Acker granted the permit.
