REGULAR MEETING
December 13th, 1937
The regular meeting of the City Council of the City of Dover was held on the 13th day of December, 1937. The meeting was called to order by Mayor Woodford and on roll call the following members answered present: Messrs. LeFevre, Burton, Vane, Keith and Hinkle.
MINUTES
Upon motion of Messrs. Hinkle and Burton, the reading of the minutes of the last regualr and special meetings was dispensed with.
CITY MANAGER’S REPORT
The City Manager’s report for the month of November was read by the Clerk and accepted upon motion of Messrs. Keith and Burton.
Upon motion of Messrs. Keith and LeFevre, Council authorized the City Manager to install sewers on Sackarackin Avenue and South Bradford Streets, with the understanding that all houses on said streets must hook up to the sewer immediately.
FINANCIAL REPORT
The financial report for the month of November was read by the Clerk and accepted and approved upon motion of Messrs. Burton and Hinkle.
ALDERMAN’S REPORT
The Alderman’s report for the month of November was read by the Clerk and accepted upon motion of Messrs. Keith and Burton. A check amounting to $356.00 was turned over to the City Manager with the report of ten arrests.
POLICE REPORT
The report of the Chief of Police was read by the Clerk and accepted upon motion of Messrs. Hinkle and Keith.
APPLICATION FOR MOVING BUILDING
Application for moving a building on North Street west to New Street belonging to Minnie J. Williams was read. Upon motion of Messrs. Hinkle and Keith, this application was rejected.
A LETTER
A letter from John H. Klingler was read asking that Council pay for the land adjoining his property on Washington Street which has been used for several years as an alley. Upon investigation, the City Manager was instructed to advise Mr. Klingler that this alley does not belong to the City, and if it is on his property he is authorized to close it at any time.
COMMITTEES
Mr. R. C. Beckett, State Sanitary Engineer, appeared before Council regarding the installation of sanitary toilets in all unsewered areas within the City limits. He explained that the cost to the City would not exceed $400.00. Upon motion of Messrs. LeFevre and Keith, the State Board of health was authorized to install these sanitary toilets and the City Manager was instructed to pay for same not in excess of $400.00
ORDINANCE
Upon motion of Messrs. LeFevre and Keith, the following ordinance was passed by vote of Council:

AN ORDINANCE REQUIRING A PERMIT TO DISTRIBUTE HAND BILLS, CARDS, CIRCULARS AND OTHER ADVERTISING MATERIALS OVER AND UPON THE STREETS, LANES AND ALLEYS OF THE CITY OF DOVER
WHEREAS, a large quantity of advertising material, commonly known as hand bills or circulars, have been distributed over and upon the streets, lanes and alleys of the City of Dover, and
WHEREAS, such hand bills or circulars have been so distributed as to create in some instances a fire hazzard and in other instances have created a great amount of waste material and rubbish in and upon the said streets, lanes and alleys of the said City of Dover.
NOW, THEREFORE, Be it ordained by the Council of the City of Dover:
Section 1. That from and upon the passage and approval of this act, it shall be unlawful for any person, group of persons, firm, association or corporation to distribute or cause to be distributed over, and upon, or in the streets, lanes and alleys of the City of Dover any hand bills, cards, circulars or papers without first securing a permit so to do, except as herein provided.
Section 2. That any person, group of persons, firm, association or corporation desiring to distribute any advertising material over and upon the streets, lanes and alleys of the City of Dover shall first make application to the City Manager requesting permission so to do and first satisfying the City Manager that none of said handbills or circulars will be permitted to escape upon or into the streets, lanes and alleys of the said City of Dover. And further, that such circulars or hand bills will be placed only in such doors, boxes or other containers as will assure the safe keeping thereof until the same shall have been removed by the owner or person in possession of such doors, boxes, vehicles or other containers, and particularly that the said applicant will not place nor permit the placing of any circulars or hand bills in or upon any automobile, porch, portico or steps so that the same might or shall blow about the streets, lanes or alleys of the said City.
Section3. Upon being satisfied that said applicant will conform to the provisions of this ordinance, the said City Manager is authorized to issue a permit to such applicant upon the payment therefor by said applicant of a fee of $2.50 for each time specified in such permit during which such permit will be effective. No permit shall be effective for more than 30 days next after the date thereof.
Section 4. Any person, group of persons, firm, association or corporation violating any provisions of this ordinance shall upon conviction thereof be fined not less than $5.00 nor more than $25.00 for each separate offense.
The finding of hand bills or circulars under the name of any person, group of persons, firm, association or corporation, upon the streets, lanes and alleys of the City of Dover contrary to provisions hereinabove set forth shall be prima facie evidence of the guilt of such person, group of persons, firm, association or corporation circulating such hand bills or circulars.
Section 5. Any charitable, religious or group of social workers desiring to distribute hand bills or circulars over and upon the streets, lanes and alleys of the City of Dover, shall before so doing secure a permit as provided in this ordinance, except, however, that no fee shall be charged or collected for the issuance of such permit.

ADVERTISING
Upon motion of Messrs. Keith and Burton, the City Council voted to discontinue all advertising in newspapers, except that which is required by law.
