FOIA Guideline Changes per Governor's Order

IMPORTANT INFORMATION - CHANGES TO FOIA UNDER GOVERNOR CARNEY'S STATE OF EMERGENCY DECLARATION

Delaware is currently in a State of Emergency due to COVID-19. FOIA requests are being processed as quickly as possible under the current State of Emergency restrictions. Please be advised that due to restrictions on staff, facilities, and databases, we may be unable to process some requests until the State of Emergency is lifted. We apologize for any inconvenience.

Please see the language below that was included in Governor Carney's Fourth Modification of the Declaration of a State of Emergency for the State of Delaware.

The statutory time periods for responses to requests for public records made pursuant to 29 Del. C. § 10003 and for the filing of and response to petitions filed pursuant to 29 Del. C. § 10005 (e), whether such requests or petitions are presently pending or submitted hereafter, are hereby extended until 15 business days following the termination of any active Declaration of a State of Emergency.
